Achieving a Just Outcome in a Challenging Domestic Violence Case

Our client, a man in his late 50s, faced serious charges of assault arising from a domestic violence incident. The allegations involved striking the victim in the face and making threats to the victim’s life. This conduct was entirely out of character for our client, who had never previously been involved in any domestic violence matters.

The incident occurred during the breakdown of a long-term relationship spanning over 25 years. At the time, our client was struggling with a diagnosis of Major Depressive Disorder, which contributed to the emotional turmoil surrounding the separation.

The Prosecution’s Approach

The prosecution sought a prison sentence, and the presiding Magistrate initially shared the view that incarceration was appropriate given the seriousness of the offence.

Madsen Law’s Intervention

Madsen Law was engaged to assist our client in securing the best possible outcome. We met with our client to develop a comprehensive plan, focusing on both legal strategy and rehabilitation. A guilty plea was entered at an early stage.

In our submissions to the Court, we emphasised several key factors:

  • The offence was entirely out of character.
  • There was no prior history of domestic violence or criminal conduct.
  • Our client had taken immediate steps to address his mental health and engage in rehabilitation.
  • The breakdown of a long-term relationship and the diagnosis of Major Depressive Disorder were significant contextual factors.

Outcome

The Magistrate ordered 18 months’ probation and no conviction be recorded.

Through careful preparation and advocacy, Madsen Law was able to present a compelling case for leniency. The Court was persuaded that our client’s actions were not reflective of his character and that he had demonstrated genuine remorse and commitment to rehabilitation.
