What To Do If You’re Facing Criminal Charges for the First Time?

If police have contacted you or you’ve been charged for the first time, the steps you take next are important. Below is a clear, straightforward process to follow.

1. Receive the Charges or Paperwork and Stay Polite

When police provide you with paperwork (such as a Notice to Appear or charge documents), remain polite and respectful.

There is no benefit to arguing or trying to discuss the allegations on the spot. Staying calm prevents the situation from escalating.

2. Do Not Discuss the Matter — Ask to Speak With a Solicitor

You are not required to answer police questions about the allegations.

Simply say:

“I want to speak to a solicitor before answering any questions.”

(The only information you must provide if asked is your name and address)

Anything you say can be used as evidence, even if you believe you are helping yourself. If asked further questions, you can say “no comment”.

3. Contact a Criminal Lawyer Immediately

Call a solicitor who practises in criminal law — such as Madsen Law Solicitors in Logan.

Madsen Law can:

Contact police on your behalf

Organise a suitable time to attend the station

Attend with you if needed

Advise you on how to manage the situation and protect your position

If you are local, one of our criminal lawyers may be able to come to you or meet you at the police station.

Why You Should Not Speak With Police First

Remaining silent is not about being uncooperative — it is about avoiding accidental self-incrimination.

If police are charging you, they are also looking for further evidence. Speaking without legal advice can make your situation more difficult.
