The court, however, emphasized the ICL’s unique role, outlining that removal should only occur for substantial reasons, such as deliberate misinformation, unethical behavior, bias, incompetence, or a conflict of interest.

In the case of Halston and Neast, a father sought the urgent return of his two children, aged 9 and 5, from 150 kilometers away in country South Australia where the mother had unilaterally relocated. The Court weighed the competing legal principles of the mother’s freedom of movement against the children’s entitlement to a beneficial relationship with both parents. Ultimately, the Court found that the mother’s unilateral decision to relocate could not be condoned and ordered her to return to Adelaide with the children within two months.
